【中国禁闻】毒奶粉赔偿基金成谜只闻不见

【新唐人2011年5月18日讯】三年前"三聚氰胺奶粉"事件爆发后，在政府主导下，乳制
品行业协会牵头设立了医疗赔偿基金，并交由中国人寿保险管理。但是据结石宝宝家长
说，至今没有受害人从中领取任何赔款。媒体试图了解这个基金的运作，相关部门却声
称那是"国家机密"，拒绝透露。

2008年年底，在政府主导下，中国乳制品协会牵头由22家涉案企业，集体出资成立了总
额2亿元的"医疗赔偿基金"，作为对毒奶粉事件近30万名确诊患儿的善后措施。

《了望东方》周刊报导，"医疗赔偿基金"在过去两年多时间里的赔偿情况、管理运作方
式、现金馀额都是一个谜。对于《了望东方》的调查访问，相关机构和企业都百般推
脱。周刊致电中国乳制品工业协会，询问能否公布一些基本资讯。负责人表示"不行
"，并且说这是"国家机密"。负责人还说，关于这个赔偿基金，不宜对外报导。

毒奶粉事件发生之初，法律界人士根据卫生部门公布的确诊人数，以及现行法律规定的
较低赔偿标准，推算出赔偿资金总额约为39亿元。建议起步资金不低于39亿元。但是最
终结果是，由22家涉案企业共同出资11亿多元，其中，9亿多元用于对患病婴幼儿当时
治疗和赔偿的现金支出，2亿元则成立医疗赔偿基金。

这两亿元的基金在很多患儿家长听来像是一个传说，因为没有人见过，拿到过。人们普
遍了解的是，卫生部出台了一个"一揽子赔偿"计划，它的赔偿标准是，死亡赔20万
元，重症赔3万元，普通症状赔2000元，并且要求家长在拿到赔款的同时，放弃未来起
诉和索赔的权利。许多家长拒绝接受。

胡春海（浙江结石患儿家长）："以前不是他们有"针对性赔偿"嘛，但是我们没有去签
那个字。我小孩是双肾结石，当时赔的是两千块。然后要签让我们不要起诉嘛，但我们
一直要起诉的，我们没有接受这个赔偿。"

胡春海向《新唐人》表示，他也从来没有获得所谓"医疗赔偿基金"的赔款。他认为，这
个"基金"可能根本不存在。

胡春海（浙江结石患儿家长）："据我所知，他们平安保险根本就没有的，保险这一块
也是没有的（您怎么知道？您听谁说的？）因为从来就没有人跟我们提起过这个事情。
我们通过这个事情也认识了很多结石宝宝的家长，大家都有交流。都没有听说过。"

广东结石患儿家长丘运文也表示，除了获得两千元的赔偿金之外，2009年以后，他女儿
所有的检查治疗都是自费。

丘运文（广东结石患儿家长）："现在带小孩去检查都要自己出钱。零九年八月份以后
我们去检查都要自己出钱，那两千块拿来连车费都不够。"

丘运文女儿的结石大的有4×0.8厘米，更加棘手的是，还有许多像针尖大小的石头，长
在肾里面，连手术都无法去除。而荒唐的是，中国医院为了压低患儿数量，将0.4厘米
以下的结石不作为，没有处理、不告诉家长、也不上报。

丘运文（广东结石患儿家长）："像我弟弟的小孩他检查出来也是有的。零点四以下他
不给上报就说没有。他本身在医院做护士的。这样办起来可能全国有几千万个儿童。我
两个弟弟在我们县检查都是有结石，但是到市里面检查他就说没事。"

"三聚氰胺事件"已经过去近三年，如今，除"三鹿"破产之外，其他涉案的乳品企业都继
续兴旺发展。胡春海认为，如果不是政府在维护毒奶粉涉案企业，阻止法院立案索
赔，很多企业都应该倒闭。

Compensation Fund, A "State Secret"

After the melamine milk powder incident brokethree years ago, the Chinese
governmentasked China's Dairy Industry Associationto set up a compensation
fund,managed by the China Life Insurance Co., Ltd.According to the parents
of affected babies,no one has received anything from the fund.When the
media attempted to understandthe operations of the fund, its related
departmentsclaim that it was a "state secret."

At the end of 2008, the Chinese Communist Party(CCP) asked The China Dairy
Industry Associationto lead the 22 enterprises involved in the incident,and
collect a medical compensation fundof RMB200 million, to be used for the
nearly300,000 children affected by the baby formula.

According to Oriental Outlook weekly magazine,the operation and balance of
the fund is a mystery.When the reporter called the China Dairy
IndustryAssociation asking for basic information,the staff in charge
refused to answer,and claimed it was "state secrets." They also saidthat
the information on the compensation fundwas not for external reporting.

When the toxic milk powder incidentwas first exposed, legal professionals
suggesteda RMB3.9 billion compensation fund,based on the data from the
Ministry of Healthand the low standard of the compensation law.However, the
22 companies that were involvedin the incident contributed RMB1.1 billion
only,900 million of which was used for treatmentof sick infants and cash
compensation,and 200 million as medical compensation fund.

To parents of affected children, the fund is a myth,as no one has ever seen
it or got it.It is understood that the Ministry of Health issueda
compensation package: RMB200,000 for death,RMB30,000 for serious
sicknessand RMB2,000 for normal sickness.They asked parents to give up
their right to sueor claim in the future when they get the money.Many
parents refused to accept the condition.

Hu Chunhai (parent of melamine milk victim):"They had the "targeted
compensation" plan.We did not sign. Both kidneys of my kid have stones,and
in order to get RMB2,000 we needed to signsaying we wouldn't sue or file
claims in the future.We will continue to sue and file claims,so we did not
accept the compensation."

Hu Chunhai told NTD that he never received moneyfrom the fund. He thinks
the fund might not exist.

Hu Chuhai (parent of melamine milk victim):"As far as I know insurance
companies don't have it.(How would you know?) No one told me about it.I
know many parents of other victim kids,no one heard about it."

Guangdong parent of melamine milk victim,Qiu Yunwen, said that in addition
to the RMB2,000since 2009 all the medical examinationfor his daughter was
paid out of his pocket.

Qiu Yunwen (parent of melamine milk victim):"We have covered the medical
examinationexpenses for my kid. The RMB2,000cannot even cover commuting
expenses."

Qiu's daughter has a large stone of 4x0.8 cm.What is more problematic is
there are tiny stonesin the kidney that cannot be removed.In order to
minimize the number of affected kids,stones smaller than 0.4cm were not
countedor reported, and parents are not informed.

Qiu Yunwen (parent of melamine milk victim):"My brothers' kids have kidney
stones,but the report said that they did not.My brother is a nurse in the
hospital.There might be tens of millions of childrenwith kidney stones. Two
of my brothers childrenwere diagnosed with stones when examinedat the
county level, but not at the city level."

The "melamine incident" was almost 3 years ago.The only dairy business that
bankrupt was Sanlu,other involved dairy companies continue to thrive.Hu
Hanchun thinks that many businesseswould have gone bankruptif it were not
for the government to preventcourts from filing claims of compensation.
