【禁闻】官批独立候选人非法 民间仍要参选
【新唐人2011年6月10日讯】在今年大陆掀起公民参选人大代表的风潮之后,中共做出
回应。全国人大法工委某负责人表态说,"独立候选人没有法律依据"。但有独立参选人
认为,"独立候选人"这只是一个不规范的叫法,本身就是指『公民联名推荐候选人'。
也有人反应表示,当局在称谓上大做文章没有必要。
6月8号,大陆「新闻联播」引述这位匿名发言人的话说,根据中国《宪法》和《选举法
》,中国的县乡人大代表候选人,只有"由各政党、各人民团体和选民依法按程序提名
推荐"的"代表候选人",经讨论、协商或经预选确定的"正式代表候选人",没有所谓的
"独立候选人"。"独立候选人"没有法律依据。
《法国国际广播电台》记者曹国星认为,这是中国官方(中共)对这次县乡基层人大选
举中,涌现的"独立候选人"现象,发出的黄牌。
吴丹红(中国政法大学副教授):「这个称谓本身就应该叫『公民联名推荐候选人'或
者『公民联名推荐参选人'。而且这个里面也已经提到了,公民十个人以上可以联名推
荐。所以实际上意思上是一样的。我们民间说这个独立候选人,也就是我们说的公民十
人以上联名推荐的意思。这个意思在他里面已经表述的很清楚了。只是说我们之前独立
候选人的提法是不规范的。」
去年曾经参选北京律师协会主席的北京律师杨慧文认为,官方在"独立候选人"的称谓上
大做文章没有必要。
杨慧文(北京律师):「因为选举制度是为了促�民主,促�选举制度科学化,不是说
拿上一个东西刻板的,咬文嚼字的去做这些文章。如果这样的话,那法制都没有什么实
质意义的。法制的精神在于他的精神。」
将参选成都市武侯区人大代表的作家李承鹏说,人大似乎不是说"独立候选人"没法律依
据就不能参选,而是指说"独立候选人"这提法没法律依据。
宣布将参选北京市昌平区人大代表的时评作者"五岳散人"则表示,"其实叫什么都不重
要,我们还是独立于这个体系之外�行参选。"
针对公民参选的风潮,宣传部发出禁令,要求媒体封杀独立参选的报导,多名参选者受
到国保约谈。成都、北京等地的党委宣传部已发出禁令,禁止媒体报导李承鹏的参选活
动。
这次人大官员的表态,是否意味着当局开始打压公民参选的势头?
宣布参选区人大代表的《姑苏晚报》编辑吴林表示,目前他的竞选活动还没有遇到来自
中共的任何阻力。他认为公民参选是一个好事情,有助于提高公民权利意识,当局没有
理由打压。
吴林(《姑苏晚报》编辑):「这个事情是宪法规定的事情,而且是在法律现象之
内,当局为什么会感觉到威胁呢?当局应该感觉到欣慰,是民众参与,而且民众又不是
对抗政府,只是行使宪法赋予的权利。」
自中国作家李承鹏5月25号通过微博,率先公开确认参选基层人民代表后,一股"公民自
荐参选人大代表风"迅速刮起,截至5月29号,至少有近百人表明,依法独立自荐参选所
在地的基层人大代表。这些人当中,有「天涯社区商务运营」总监梁树新、中国作家协
会会员夏商、中国政法大学副教授吴丹红等。
作家兼房地产商曹天宣布要竞选郑州市市长。曹天承诺,参选成功后自己任期内不拿一
分钱工资,并且城管绝不可能打百姓,官员腐败一定严惩。

Independent Candidates "Illegal"
The Chinese Communist Party (CCP) respondedto the increase of individuals
participatingin local elections. The authorities branded"independent
candidate" as illegal. Participantssaid "independent candidate" is just
name, and isn'tdifferent to "candidate jointly recommendedby the voters."
Many say authorities over-reactedon the name of "independent candidate."
On June 8, CCTV quoted an anonymous expertby saying that according to the
Constitutionand the Election Law, candidates for local electionscan only
come after the recommendationand discussion of different parties, people's
groupsand voters. "Iindependent candidate" does not existas it has no legal
grounds, claims CCP's mouthpiece.
Radio France Internationale reporter Cao Guoxingsaid this was CCP's
official warningto the mushrooming "independent candidates".
Wu Danghong (A/Professor at China Universityof Political Science and Law):
"The term should be'candidate jointly recommended by citizens',as 10 or
more citizens can recommend a candidate.So, when it says
grassroots' 'independent candidate'it means a candidate recommended by 10+
people.The meaning should be more than clear. It was justthat 'independent
candidate' might not soundas professional, but there is nothing wrong with
it."
Beijing lawyer Yang Huiwen, who ran for Chairof Beijing Bar Association
last year, said that it wasunnecessary for CCP to find fault with the term.
Yang Huiwen: "The election system was createdto promote democracy and make
the election processbetter, not something stereotypical or quibbling.It is
meaningless to quibble a law in terms of its text.The rule of law lies in
its spirit."
Li Chengpeng, an independent candidate in WuhouDistrict of Chengdu city
said, CCP did not seemto discourage independent candidates to run,only to
point out that the term lacks legal grounds.
"Wuyuesanren", who runs for Changping District,Beijing said, "No matter
what we are called,we are independent of the regimewhen we participate in
the election."
The Propaganda Dept. ordered media not to reportthe independent
candidates.Several candidates have been taken to national securitybureau
for interrogation. The propaganda depts.in Beijing and Chengdu ordered all
media not to reporton Li Chengpeng's election activities.
Is the official warning indicative of the onsetof CCP's crackdown on
independent candidates?
Wu Lin, an editor and independent candidate, saidhis campaign did not
encounter CCP resistance yet.According to Wu, citizen participation in
electionsis a good thing and helpful in raising awarenessof citizens'
rights. CCP has no reason to suppress it.
Wu Lin: "This is endowed by the Constitution.It is within the legal
boundary. Why did authoritiesfeel threatened? The CCP should be
happybecause so many people participate in the election.They were not
against the CCP, but simply wanttheir rights, guaranteed by the
Constitution."
Since writer Li Chengpeng announced on May 25,he would run in the election,
a wave of individualelection participants surfaced. Since May 29,
100+people announced they would run in the election.They include Liang
Shuxin, online company CEO,Xia Shang, member of a writers' association,and
Wu Danghong, an associate professor.
Cao Tian, writer and real estate agent, said he wouldrun for Zhengzhou
mayor. He promised not to takeany salary once elected, to order city
inspectorsnot to harm people, and to punish corrupt officials.
