【禁闻】深圳驱逐八万人 律师：不合法

【新唐人2011年4月13日讯】第廿六届世界大学生夏季运动会，将于8月在深圳举行。为
此，深圳警方召开新闻发布会，表示在过去的100天里，已令八万多名所谓「治安高危
人员」离开深圳，今后会更加严打犯罪份子，并招募五十万名市民，就地监察。中国维
权律师李和平表示，这项做法「违法」。

为准备第廿六届「世动会」8月在深圳举行，当地警方由元旦起实行「治安高危人员排
查清理百日行动」，这期间，当局拘捕了8千多人，并驱逐超过八万名的所谓「治安高
危人员」出深圳。

深圳市公安局副局长兼新闻发言人解释，所谓「治安高危人员」，是指没有正当理由而
长期滞留深圳，行踪可疑，对深圳治安和市民生命财产安全，构成现实威胁的人员。他
还表示，这项行动不会停止，还将召募五十万名市民当「红袖章」人士，监察家居或范
围内的人，并在各小区加设闭路电视，监察人员�出。

中国知名维权律师李和平表示，警方凭着自己的「主观印象」区分人群，这本身就不合
法。

李和平（维权律师）：「第一，中华人民共和国宪法规定，法律面前人人平等。每一个
人的合法权利都要受到法律的保护。那么深圳将八万人，他们认为的所谓的特殊人
群，就要�行驱赶，那么显然是违背了这条。第二个，行政法有个原理就是说法律授权
你才能做，法律没有授权，行政机关工作人员做了，那都是违法甚至是犯罪，这显然是
违法的。违反行政法的一个基本的原理。」

深圳居民孙先生向《新唐人》表示，这种做法让老百姓人心惶惶。

孙先生（深圳居民）：「这样就害苦了很多的老百姓，很多的平民百姓就遭殃了。有很
多老百姓想到这里来找份工作啊，想到这里找点小生意做啊，也是想到这里来安下来过
点小日子啊，但是他就把这么一些人全都弄得人心惶惶的。」

河北《燕赵晚报》批评说，警方目前的做法只会让这些人生活无着落，增加社会的不稳
定因素。而一刀切的把所谓的「治安高危人员」清理出自己所辖的城市，显然是一种懒
政。

张先生（深圳居民）：「我们这个执政党，现在就是由于那个埃及的暴动以及一些国家
推翻独裁政权，那我们中国的执政的主体有一定的困难度，现在我们中国共产党已经领
导了我们62年了，但现在为止，他们也很恐慌。埃及事件啊，一个是贪污，第二个就是
就业，再一个就是物价高起。我们中国也存在埃及的问题。我们中国现在也存在贪污。
第二，失业，还有物价高起等。」

《国际在线》有文章指出，其实，一个大型赛事活动的安保，就是检验一个国家的文明
程度，我们不能因为安保任务重，就采取一刀切的方式来剥夺公民的合法权利，这违背
了大型国际赛事举办的初衷。这与「大运会」核心价值不符。

而深圳独立学者朱建国告诉《自由亚洲电台》，深圳警方在 「治安高危人员」七类人
中，特别提到了「有报复社会的极端言行，可能危及他人或公共安全的」人员，他
说，「这个模糊的界定很可能成为有关当局打击民间声音的藉口。」

80,000 "high-risk security personnel"to leave Shenzhen in the past 100
days.They'll also strengthen the crackdown on criminals,and will recruit
500,000 residents to help monitor.Chinese human rights lawyer Li
Hepingstated that this practice is "illegal."

Since January 1, Shenzhen police have implementedthe 『100 Day Operation to
Investigate and CleanupHigh-Risk Personnel,' for August's26th Summer World
University Games.During these days over 8,000 people were arrestedand over
80,000 people were expelled.

Deputy director and spokesman of Shenzhen CityPublic Security Bureau
explained the so-called"High-Risk Security Personnel" refers to thosewho
lived long in Shenzhen without justification,without steady whereabouts,
and pose real threatsto the City safety, the public life and property.He
also expressed this operation will continue.They will recruit 500,000
people as 『red armbands'to monitor people at home and those within
theprofile in particular, and will install camerasin each neighborhood to
monitor people in and out.

China's renowned human rights lawyer Li Hepingsaid it is illegal for the
police to single out peoplebased on their own "subjective judgment"

Li Heping: "First, the Chinese Constitution statesequality is before the
law. The legal rightsof each individual are protected. It is against the
lawto expel 80,000 people whom the police singles out.Second, the principle
of administration is based onauthorization by law. If the law does not
authorizethe administrative staff to carry out an operation,it is illegal
or even criminal to carry it out.It is a violation of the fundamental
principleof the administrative law."

Shenzhen resident Mr. Sun told NTD Televisionthat this operation makes
people panic.

Mr. Sun: "It hurts a lot of people. Many people cameto Shenzen to look for
a job or to do small business.They want to settle down to start a life.What
the police is doing makes people panic."

Hebei Province's Yanzhao Evening News criticizedthe current practice as
taking away people's incomeand increasing social instability. To clean
upthe so-called "high-risk people" out of the cityunder their jurisdiction
is an obvious lazy practice.

Shenzhen resident Mr. Zhang: "Due to Egypt's riotsand the overthrow of some
totalitarian regimes,the Chinese government has some difficulties.The
Chinese Communist Party (CCP) ruled Chinafor 62 years and is panicking
now.The reasons for Egyptian revolution are corruption,unemployment and
sharp price increases.We also have these problems in China,
corruption,unemployment, and sharp price increases."

An article from International Online points out,that the security work for
a large sports eventis a test to a country's level of civilization. "We
can'tdeprive citizens of their rights to heavysecurity protection. This is
against the purposeand core values of major international events."

Shenzhen independent scholar Zhu Jianguo toldRadio Free Asia, that the 7
categoriesof 『High-Risk Security Personnel,' particularlymention "
revenging on society with extreme wordsand actions that, might endanger
public safety."Zhu Jianguo: "Such vague definition is likelyto be the
authorities' excuse to suppress people." 『
